Privacy and Data Policy
Koko Fitness, Inc.’s Website & Smartrainer Exercise Program
Koko Fitness, Inc. (“Koko”) is committed to maintaining the confidentiality of your personal information. This policy governs how Koko uses information it collects from and about you through KokoFitness.com and MyKokoFitness.com (the “Sites”) and the Smartrainer Exercise Program (the “Program”). It does not govern Koko’s use of information it gathers through other means. Koko reserves the right to amend this policy from time to time without notice. We encourage you to review this page periodically because any changes will be binding on you.
Information We Collect
Koko collects the information you provide when signing up for the Program, including but not limited to your name, address, gender, age, height, weight, email address and your selected fitness program. You may review this information by logging into your profile. Koko also collects information generated when you use the Program data key (your “Key”) in Program-enabled fitness equipment. This information may include your workout location, the time you used the machine, various statistics about your workout, and other information. Koko Fitness does not capture or store any personal financial information you provide to your health club.
Whose Information We Collect
We collect information from people who voluntarily provide it to us and people who use the Program. The Sites and Program are not intended for children under the age of 16, and we do not knowingly collect information from children under the age of 16.
How We Use the Information We Collect
Koko retains ownership of all information we collect. We reserve the right to use this information in any manner, subject to the terms of this Privacy and Data Policy.
We may use information we collect to help you track your progress and make recommendations for your individual fitness program, to make improvements to our Program, and for other purposes.
We may share your collected information with your health club, along with information about your fitness progress. Your health club is not governed by this policy, and we do not control how your health club uses the information we provide to them. You should review your health club’s policies to learn how they treat this information. Upon your request, we may also share your information with your health care provider, insurance company, employer, or other third parties.
We may use your information to tell you about businesses that offer products and services that may be of interest to you. However, we do not share or sell your name or contact information to third parties other than your health club. If you do not wish to receive these types of offers, you may send us an email including your name and email address to firstname.lastname@example.org
We may aggregate information we collect from Program participants, including demographic information, but not including your name, street address or email address. We reserve the right to make any and all uses of this aggregated information, including the right to sell it to third parties.
Koko might sell some or all of its assets. In such transactions, customer and user data and Collected Information generally is one of the transferred business assets. Also, in the event that Koko or substantially all of its assets are acquired, such information may be one of those transferred assets, and we reserve the right to buy or sell such assets.
Koko takes reasonable steps to protect information transmitted to us through the Sites and via the Program kiosks. However, electronic communications may not be secure, and there is a risk that information transmitted to us may be accessed by unauthorized third parties. Koko does not represent, warrant or guarantee that information sent to us will be protected against unauthorized access, loss, misuse or alteration.
Use of portions of the Sites requires you to establish a password. You agree that you will be responsible for maintaining your password as confidential and for any activity that occurs as a result of your sharing your password with another. Koko is not responsible for any loss or damage arising from your failure to comply with the provisions of this section.
Special HIPAA Notice
This section applies to you only if you are participating in the Program through your physical therapist or health care provider (your “Provider”). If you are not certain if this includes you, you should ask your provider.
If your provider gives us any of your personal health information, we treat it in accordance with the requirements of our agreement with your Provider under the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA). Such information does not include your name or address but rather a unique identifying number.
